RESOLUTION NO. 2019-092 A RESOLUTION OF INTENT TO REZONE A C-C2 GENERAL COMMERCIAL PROPERTY TO C-I1 LIGHT INDUSTRY, OF THE MISSOULA COUNTY ZONING REGULATIONS, LEGALLY DESCRIBED AS: LOT 2A OF SPENCER SUBDIVISION LESS AND EXCEPTING PORTION A OF LONG ADDITION, S28, T14 N, R20 W. WHEREAS, 76-2-201 M.C.A. authorizes the Board of County Commissioners to adopt zoning regulations; and, WHEREAS, the Board of County Commissioners did adopt zoning regulations for Missoula County through the passage of County Resolution 2017-039; and, WHEREAS, 76-2-202 M.C.A. provides for the establishment and revision of zoning districts; and, WHEREAS, a notice of public hearing was advertised in the Missoulian April 14th and April 21st 2019; and, WHEREAS, a request to rezone the property legally described above from C-C2 General Commercial to C-I1 Light Industry was reviewed by the Missoula Consolidated Planning Board at a public hearing held on May 7, 2019; and, WHEREAS, the Missoula Consolidated Planning Board voted to recommended approval with nine board members in favor and no board members opposed of the MVP Holdings LLC rezoning request; and, WHEREAS, a hearing was held by the County Commissioners of Missoula County on June 6, 2019, in order to give the public an opportunity to be heard regarding the request to rezone the property legally described above to C-I1 Light Industry and, WHEREAS, the County Commissioners resolve to make a clear record of their intent to zone the subject property; NOW, THEREFORE, BE IT RESOLVED that the Board of County Commissioners of Missoula County will receive written protest for a period of thirty (30) days after publication of this notice on June 16, 2019, from persons owning real property within 300 feet of the boundary of the subject property; and FURTHER BE IT RESOLVED that the Board of County Commissioners of Missoula County will zone the above-described property C-I1 Light Industry, subject to application of any legal protest; and FURTHER, copies of the C-I1 Light Industry Zoning District are available for inspection at the office of the Missoula County Clerk and Recorder and the Planning Office.
