A 51-year-old homeless man accused of raping a woman in a Missoula alley in early August pleaded not guilty in Missoula County District Court Wednesday morning.

According to court documents, officers found Tommy Dale Edmondson lying on his victim in an alley off of North Orange Street on Aug. 7, shortly after 5 p.m. The victim was sleeping or passed out and Edmondson was lying between her legs.

The victim declined medical attention, but agreed to give a statement to police. She told a detective the man had bought her alcohol and then forced her to have sex with him. She said he held her down even after she told him no, but she didn’t fight back because she was afraid he would hurt her.

Edmondson told police she never said no and she seemed to know what she was doing.

He appeared in Missoula Justice Court for his initial appearance on Aug. 8, where he gave no address and said he had just arrived in Missoula the previous day.

Edmondson remains in the Missoula County jail pending a $50,000 bail.
