A Missoula man accused of raping a 13-year-old girl pleaded not guilty Wednesday in Missoula County District Court.

Leo Henry Green, 18, is charged with a single count of sexual intercourse without consent.

Green is being held in the Missoula County Detention Facility on $75,000 bail.

The 13-year-old girl told police she’d been drinking alcohol with Tatyona Marie Northcutt, 18, at a University of Montana family housing unit when Northcutt asked if she’d be willing to have a three-way with Green, according to charging documents.

But Northcutt later became jealous and assaulted Green, the documents said. Northcutt was charged with misdemeanor partner/family member assault.

Green allegedly admitted knowing the girl was underage, but said he thought maybe she was 14 or 15, the documents said.

Sexual intercourse without consent is a felony carrying a penalty of between two and four years in prison and up to 100 years or life, and a $50,000 fine.
