BOZEMAN — A Bozeman man is charged with negligent homicide in the death of his 7-month-old son.
Vincent Leroy Garbe was charged Friday and his bail was set at $50,000. He did not enter a plea. Attorney Brigitte Carneal argued for lower bail that would allow Garbe to attend his son's funeral.
The Division of Child and Family Services had prohibited Garbe from being with the baby unsupervised after the infant suffered a fractured neck in January. Officials say Garbe had been drinking alcohol when he either fell on the child or while him.

Garbe told investigators his girlfriend went to work Thursday and he smoked marijuana before falling asleep. He said he found the baby lying in an awkward position in his crib just after 10 a.m. Prosecutors say he delayed calling 911.
Court records do not indicate a cause of death.
