HELENA - A 43-year-old Helena man faces two charges of deliberate homicide after police say he killed two brothers in a Helena apartment building.
Prosecutors also filed a felony charge of assault with a weapon against Tilmon R. Nungesser IV, who allegedly threatened another neighbor with the same shotgun authorities believe he used to slay the two men.
Nungesser is accused of fatally shooting Robert Alan Mishler, 40, and William Andrew Mishler, 42, on Saturday night just after 9 p.m.
Nungesser is in jail in lieu of $500,000 bond.
Court documents say Nungesser told investigators he took his shotgun to confront two men who lived in the apartment above his, and he went there with the intent to shoot them. He then admitted to shooting both men, the arresting officer wrote.
The documents do not state why Nungesser approached the Mishlers or if the men have a history.
During his brief court appearance Monday afternoon, Nungesser asked to be assigned a public defender.
Nungesser is employed by the Lewis and Clark County roads department, according to his booking sheet.
He has no criminal record in any of the three local courts.
A neighbor in the Sherwood Apartments, 301 W. Lawrence St., where the three men all lived, called to report shots fired at 9:13 p.m. While on the phone with the neighbor, the dispatch operator heard multiple gunshots, according to documents filed in Lewis and Clark County Justice Court Monday morning.
Police found the brothers dead in a second-floor hallway. Officers noted the men's significant wounds were likely caused by a shotgun.
In the building's basement hallway, officers met with Nungesser, who had blood spatter on his face and clothes, the documents say.
"Nungesser said he was the 'One you are looking for,'" court documents state. He then told officers the loaded shotgun was inside an apartment on the kitchen counter.
Nungesser was booked into jail at 3:40 a.m. Sunday.
