Since the migrant children in the U.S. are minors, they are unable to represent themselves in court. Under our standards of justice, a guardian ad litem (which is a guardian appointed by a court to protect the interests of a minor) must be court appointed to represent them. This guardian is usually an attorney.

Thus a random herding of children for deportation without these safeguards is illegal and immoral.
